Today is 2023/6/2,
the background of this article came from recent events reported in TV news in
Taiwan, and the related discussion between I and my friends; this content doesn’t involve any truth of the
reported news, it only contains my idea of [business management] and [career]
similar to those words, people and their work roles and behavior I know from the news,
and I utilize them because they are similar to those things I dealt with in the
past and things I know in other workplace.
My opinion came
from my work experience and work logic, it may be different from those legal
regulation you’ve already known; please be invited to share your idea and
interact with me.
Description of the
news is as below:
1. There was a female
employee of a specific political party reported her encountering a sexual harassment
by someone, however, the responsible manager didn’t deal with it; and, their
reaction and the explanation of the reaction is as below reasons:
(1) The case manager didn’t want to deal
with it and asked this employee: “What do you want me to do?!”
(2) “After discussion, the report party didn’t complain again, so, we didn’t
deal with it. “
(3) “ It was at the moment of election, to look at the big picture, we
didn’t want it to be exposed.”
2. In a period of
sightseeing tour, a person encountered a sexual harassment by another person in
the team, however, there was a person persuaded her not to fight back: “The
area you were harassed is small, give up the fight.”
3. Discussion: If the
sexual harassment was caused from the victim person’s scanty dress, does he/she
need to take the responsibility of their own encountering first?!
This is a serious topic, so, before that, I would

My opinion is listed below and remarked by colors

1. The crime of a person intentionally appearing in public without clothes is
[harming public morality] rather than [everyone can offend them]; let alone the...
2. If a supervisor knows a misconduct
exists, however, the employee must complain it to request for the supervisor’s
dealing with it, the supervisor is like the accomplice who watches from the
sidelines and allows the misconduct
to continue(including doing harms and false accusation).
3. In
the 21st century, if a managing person didn’t expect an unsolved controversy may cause it being resorted to the
media or having a greater negative impact, the root cause may be that the managing
person’s lack of practical management experience. Are they looking at the big
picture in the beginning?!
4. It is true: If someone tells you that it’s wrong to protect yourself, that
person may need healing.
5. Please keep repeating
"Don't touch me" and/or leave the scene and report to supervisor or
government departments.
6. Complained but was asked "What do you want me to do?!"
7. To avoid being misunderstood, or, other's dress style, smell of perfume
makes you unable to concentrate or feel uncomfortable at work, you can consider
doing this...

Do you agree with idea of this topic?!
People who have done something harmful to the
public morality also have the rights that others cannot offend and touch them
that against the rights. Is there anyone who disagrees with this idea?!
On the contrary, if the style of wearing clothes of
our colleague or the other party in the meeting would cause you not behaving
properly, please refer to below advice in 7.
2. If a supervisor knows a
misconduct exists, however, the employee must complain it to request for the
supervisor’s dealing with it, the supervisor is like the accomplice who watches
from the sidelines and allows the misconduct to continue(including doing
harms and false accusation).
People in a managerial position, no matter in which
work level or department, the major difference of their work role with
non-managerial role is they are empowered bigger work power to do things and an
easier way to talk to their higher management team to make some specific things
completed.
Fact exists because it happened not because there is evidence can prove their existence.
A manager knows
the thing exists, or, maybe it exists, the most important thing is to assist
the both side to protect their rigts, for example: to
assist the sufferer to prepare evidence, and, to assist the defendant to prove
their innocence. Everything happened for a reason, at least, the statements of
one of the both side is truth, and, regardless the investigation work result,
the procedures must let the both side know the managing person and the company
take this thing seriously, and the management role is independent , they need to protect and state that in the
investigation work period and after this case, no one is allowed to take
adverse action toward the other side, thus, if it is no complaint no managing
person taking required action, the managing person is like the accomplice of
one of the sides that they allow something improper exists and passively
waiting for its happening.
“No evidence” situation exists not only in cases
related to sexual harassment but also to things about how people “feel”,
however, time and repeatedly asking questions
would tell the truth, if there is no evidence, it doesn’t mean it cannot be
well handled(the perpetrator slips out the truth), and, if there is evidence,
it doesn’t mean that is true(creating a story, creating the evidence); all in
all, when a managing person has
already known an improper situation exists, they need to initiate required action
immediately to protect physical and
mental safety and reputation
of involved parties.
3. In the 21st

It is similar to the mentally mature I’ve shared in [#Career #JobSearch #Interview]】Fear, no related work experience, job application and
interview questions, it involves how much experience they’ve dealt with before; nowadays, if
the company or responsible manager forces to close a dispute between employees
and the employer or something treated the employees unfairly but the manager
didn’t imagine this case may be exposed in the media platform or in many of
other channels to release their anger…it may because this manager is “lack of
practical management experience”, that is, their attitude or maturity and their
work responsibility is not balanced. How do you think about this opinion?!
4. It is true:
If someone tells you that it’s wrong to protect yourself, that person may need
healing.
This is for above news description 2.; there are
some people growing up in an environment of not respecting people’s physical
and mental health, or, misleading the importance, or, they were hurt and have
not completely been healed yet, they become above 2. and they tend to persuade
victims to give up fighting back, it is actually deserving of sympathy,
however, their advice does no benefit for those victims who is less subjective consciousness
relatively.
What to do?!
(1) Ignore those opinions
from people who don’t care how you feel, or, who is just curious about your
situation.
(2) “What?! Who are
you?! Louder, please?!....I-heard-nothing from you!”
5. Please keep repeating "Don't touch
me" and/or leave the scene and report to supervisor or government departments.
1st.”Boss,
please your hands don’t touch my shoulder, this is sexual harassment”.
2nd.Send
complaint to people who are also working in your company and/or send to your acquaintance.
From what I’ve already known, the most difficult
situation is the misconduct person is
the one who is in the highest work position in your company and no one saw their
behavior, however, you can send message or leave record in other way or tell
others, you can create this kind of evidence, proof and deter to stop them. For
your reference for required immediate action.
3rd.Similar to
making diary, you can also write down what was happening and keep it, you will
need to utilize it someday.
Yes,
there are two sides in one thing. The evidence, especially the self-made
evidence may not match what
really happened, thus, obviously, further investigation is very important.
4th.In all the managing procedures,
someone may want you to sign some kind of confidentiality agreement to stop
your revealing the story, however, you
can’t help to sign because of the environment you were involved and actually
you don’t want to sign it; it is you signing this agreement under duress, thus, it is invalid from the beginning.
You are welcome and reminded to consult to
professional legal opinion about this.
5th.If
you get the justice but would like to leave this work environment and you also
hesitate to do that, you are thinking: why it is you need to spend time to find
another job, it’s not your fault! “In fact, you want to leave this company
because you don’t trust them anymore because of this thing!” It is not you are
punished. So, please refer to this idea.
6. Complained
but was asked "What do you want me to do?!"
The managing
person who is responsible for the complaint case is possible to ask this kind
of question, because this person needs to clarify all the issues, not only for
rights protection but also for mental security and comforting purpose, however,
the possibility of his/her not independent is not 0%; below reaction advice is
for your reference for similar concern:
(1) To list the entire
manager’s response into the 3rd. of above 5.
(2) “I want justice,
feel secure at workplace. Please let me know what I need to do next for this
complaint?!”
It’s complicated
to deal with this in other ways, if you are not sure how to report to other higher
work level managers, do not forget you have the rights to talk to related
department of your government; make sure people close to you know this case,
release your mental burden and do not take it all by yourself only.
The advice is the
same to those who is false-accused.
Moreover, in order to protect yourself,
try not to tell others what you would like to do next, such as : ”I’ll call the
police”, “I’ll take legal actions”, it is because people who know your next
action may say something causing fear or anger to you, hence, it is not
necessary to reveal it.
7. To avoid
being misunderstood, or, other's dress style, smell of perfume makes you unable
to concentrate or feel uncomfortable at work, you can consider doing this...
(1) Report to your
manager orally or in written, request for help from them.
(2) “Firstly, I don’t
want to offend you, however, in my point of view your dress style is
scantily/the smell of your perfume makes me distract from works , is it
possible you change your style( don’t use this kind of perfume)? And, I hope
could arrange another meeting, not today.”
(3) To keep proper
distance from others, avoid to be alone with the person in the same room: I
have a peer, he demands himself if it is required to have a business talk with
one single woman, he will surely invite another woman to attend that meeting,
he would never give any chance to cause rumor about that.
